QDRO for Pension

My Attorney did not file a QDRO along

with my Divorce in 2002. My ex is now

Deceased. Can I still file QDRO? In my

divorce Decree I am entiled to 50% of

the Pension.

Pensions usually terminate with the death of the retired employee. If your ex died before retirement, QDRO or no QDRO you may not have gotten anything. Without a review of the file and situation there is no way to tell if anything can be done.

QDROs don't just happen. They are not just something you file. They are complicated and often expensive documents that are subject to the control and acceptance of each particular Plan Administrator.
