Legal Question in Family Law in Texas

I'm asking a question on behalf of my mother. We have tried time and time again to file for divorce. Each time my stepfather has ripped up the papers thrown them away or something of the sorts. Do we need his signature to file? Also are there any special circumstances that would shorten the process of getting it finalized? He has abused my mom before and noenits no longer physical because I have returned home from college and can make sure nothing physically happens, verbal abuse still occurs. She wants to leave and he won't let her leave.

No, you don't need Dad's signature to get a divorce.

File the petition and get him served. He'll either file an answer or he won't.

The time limit, from start to finish, is a minimum of 60 days.

In a perfect world, you'd have about $5000 to give a lawyer up front, and he would get some temporary orders for you.
