Legal Question in Family Law in Texas

Quick Question. My ex and I have two children, a girl whose 3.5 and a boy whose 10 months. He has not seen my son since he was 3 months old, pays no support currently, and has no interest in fathering him at all. He is fine with my daughter and will claim her as his, but not my son. How likely is it that i may have his rights terminated for my son? I'm unsure if he would do it willingly or not but I have a wonderful man that actually BOTH of my kids call daddy (since they never see their bio dad, he lives in Nebraska) and he wants to adopt my son since my son knows him as the only father figure in his life. I have an attorney that I used for our divorce I just want to get a general idea of what my chances are of this actually happening? I really do believe this is in the best interest of my son.

I assume you are not married to this man. Generally in Texas judges won't do an adoption unless the couple of married for at least 1 year.
