Role income plays in determining custody

When it comes to child custody issues in San Antonio, TX, how much weight would be given to the father in a case where the father has no visible means of support, is living with his parents, who are comfortably middle class, and where the mother of the child, a girl, is low-income (part time jobs averaging about 30 hours a week at between $9.00 and $10.00 an hour. The father has the mother terrified she is going to lose her daughter just because of this issue alone. If the past six months are any indication, the paternal grandparents would end up raising the child, as the father is generally never around.

While anything is possible in a court of law these days, I don't believe that income alone is the determining factor in a child custody case. My suggestion in such a situation? Retain a family lawyer.

The father should be ordered to pay child support for at least minimum wage. The fact that the mother is working to support her child is a huge factor in her favor. The fact that the father has shown no interest in the child is also a factor in her favor.
