Legal Question in Family Law in Texas

Seperated buy needs divorce.

My girlfriend has been seperated from her husband for over a years. She was in a documented abusive relationship. Her and I would like to get married but must go through the divorce process first. She is married in Wisconsin but now lives with me in Texas. My question is can she have an uncontested divorce since there is documented proff of physical abuse and child neglect? Also how would she go about starting this procedure? She and I both do not have a lot of money to pay attorney fees.

I sell do it yourself divorce kits if I think it will work for you.

The price depends on if there are minor children and the property that needs to be divided.

If a person has lived in Texas for at least 6 months and in the same county for 90 days, that person is now a Texas resident and can file for divorce in Texas.

The filing fee in Harris county is under $300 for a divorce.

Based on what you have stated, your girlfriend would need to live in Texas for 6 months and meet the 90 day requirement for residence in the county she wants to file for divorce. You can always use forms on your own as a pro se petitioner, but when kids are involved things typically become a little more difficult and complex. Unfortunately, the problem is that you (she) does not know how to do this, and a web message board cannot teach you how to do it.

I don't know what you mean by 'a lot of money', but if this is uncontested, it may cost less than you think. There are also many attorneys who will work out a payment plan for you, according to your paycheck schedule.
