Legal Question in Civil Litigation in Texas

I have an "antique" couch (not sure how old or even value) that was given to me well over 5 years ago by a so-called friend. Now they have decided they want the couch back and are attempting to sue me for the return of the couch. Can they win this suit?

I doubt it. The statute of limitations for tort actions, such as theft, is 2 years. For contract actions the statute is 4 years. Except for special circumstances, suits outside of these periods are barred.

My suggestion is that you figure out the value of storing the couch for five years. Get an estimate from a warehouse. Then tell them that you believe their claim is barred by limiations but that you will be willing to permit them to pick up the couch after they have paid you for storing it for five years based upon the estimate.
