copyright infringement

if a paerson uses your name and likeness in a published work without your permission, do you have any legal recourse?

It depends on where the picture was taken and for what purposes it was used. For example, a news station broadcasting a story from a public place catching someone in the background would likely be okay. Downloading someone's picture from their internet site and then using it in an advertising brochure without permission would likely not be okay. There are two issues you'd need to be concerned about: copyright infringement (if the person used an image owned by another) and misappropriation (use of someone's likeness without permission.)
