Legal Question in Civil Litigation in Texas

Me and a co-signer agreed to close a joint credit 9 yrs ago. I just found out they never canceled it. They have recent activity on it and made late payments then stopped paying it. Can file a civil suit on them?

Don't sue him. He'll lie about the agreement you made.

Write to the creditor (paper letter - no telephones, emails, text messages, etc.) and tell him to close the account. Put a date on the letter, reference the account number, and send the letter via certified mail with a return receipt requested (postage will be $5.59). Keep a copy of the letter.
