Legal Question in Civil Litigation in Texas

hall rental- request for deposit return

I rented a hall for my daughter's 15th. This was 1 yr. ago. I still have 1 yr. to the party. The owner said she could return my deposit if I cancelled on time. I cancelled at the beginning of the year, and she does not want to return my $700. My daughter is handicap and their restrooms have no access whatsoever for wheelchairs; they have a concrete slap about 1.5 feet high; impossible for my daughter to go to the restroom. Can I get my deposit back.

Re: hall rental- request for deposit return

It would depend in part on what your contract states. A lawyer would have to read it to give you proper advice.

There may be a separate issue as to whether the hall is a public accomodation and does not comply with the Americans With Disabilities Act.

If you want to contact us to make arrangements for us to review the contract and go over your rights, please let us know.

Please note we do not give specific personal advice to people or entities that are not our clients and nothing herein is designed as advice to you.
