Legal Question in Civil Litigation in Texas

Another person mule broke through there fence and mine and injured my horse. His leg will be scared for life. He will no longer have the ability to be shown or ridden for long periods of time. I was told I would have to put him down but I decided to try and mend him back to health. He has recovered however we do not know the long term affects of pain and arthritis setting in. The neighbor should not have a stud mule roaming free. His horses in his pasture are scared from attacks from the same animal and they have gotten out several times before. He has fixed his fence. He has farm burial insurance but they only want to pay for cost not damage to the animal. Do I have a case. This is in Decatur Texas and even the Judge has seen the animals out before.
