Legal Question in Civil Litigation in Texas

Can I sue the Collection Company?

My car went into collection in 2003. I started to pay the collection company the monthly 300 payments. I settled the account in June 14, 2006. I am wanting to sell the car but I havnt gotten the title or a lien release from them yet. It is now August 17, 2006 and have nothing. The individual that was going to buy the car has since backed out of the agreement, because it took to long. I have lost out of my sale from the car and it wasnt not my fault.

It always seems that when they are wanting your money they need it imediatly and when it comes down to them getting you something it is not that big of a rush.

thanks

Re: Can I sue the Collection Company?

You need to make a written demand on the finance company who originally financed your car, not the collection agency. Send it certified mail, return receipt requested and give them a deadline, like maybe 10 days. Tell them if they don't give you title, you will consider that they are converting the vehicle and that you will take whatever legal action necessary to obtain the title and any other damages you suffer because of their failure to provide title to you in a timely manner. If they don't give you title in response to this letter, you should contact a lawyer to file suit against them. Also, you might file a complaint with the Office of Credit Commissioner.
