Proof of Citizenship Form N600

My mother,Rita, was born in Jamaica on 04-16-1934. Her mother, Beatrice, is a US citizen. I have Beatrice's death certificate that says she is a US citizen. Beatrice's birth record is not on file. Breatrice died when Rita was young and not much information was passed on to Rita. I have Rita's birth certificate from Jamaica which says Beatrice is Rita's mother. I have two questions:

1) Will Beatrice death certificate be proof of citizenship?

2)Will I be able to file the N600 even though Rita was born in 1934 and the law did not go into affect until years later?

The following is an excerpt of the INA Section 301 under the definition of citizen:

(h) a person born before noon (Eastern Standard Time) May 24, 1934, outside the limits and jurisdiction of the United States of an alien father and a mother who is a citizen of the United States who, prior to the birth of such person, had resided in the United States. 302 persons born in Puerto Rico on or after April 11, 1899...

This indicates that Rita is a citizen, if Beatrice has a physical presence in the US prior to her birth.

Tranmission of citizenship to Rita will require you to show that Beatrice resided in the U.S. before Ritas's birth. You can probably complete this on your own, but I would recommend that at least you consult with an immigration attorney prior to filing. This will most likey save you a lot of time and money.
