Damages if Health Insurance Fails To Pay Causing Negative Personal Credit Histor

Several years ago I ended up in the emergency room. I received several different medical bills that were all turned over to my health insurance provider, Aetna Health Care. About a year ago I discovered that one of the bills for about $1700 was on my credit report as unpaid/collection. I called Aetna to find out why it hadn�t been paid and was told that they made a mistake and failed to pay. They admitted the bill was their responsibility. Aetna called the creditor to pay the account and to explain that it was their fault the account had gone to collections. I have tried numerous times to have this item removed from my credit report, but Central Financial Control (the credit grantor) refused to have it removed and the credit bureaus are saying the account was ultimately my responsibility. If they are correct, can I seek any damages from Aetna for the damage this has done to my credit history?

i think at this point, with aetna having in fact paid the bill and notified the credit grantor of the error, aetna has protected itself. the issue is really with cfc. i would suggest that you write a letter to them, certified mail return receipt requested, clearly setting forth the facts and confirming that aetna has attempted to clarify the matter with them and that so far cfs has been unresponsive. demand (1) that your explanation of the negative credit comment be added to your credit record and (2) that cfs show that the account has been paid in full.
