Legal Question in Insurance Law in Texas

home insurance fraud?

I own 2 homes--one my primary residence, and one rental property. Aftera hail storm last year, my insurance company gave me money to have the roof repaired on the home I live in, which I never had done (just kept the money). There was another hail storm this year, and my insurance company gave me money to have the roof replaced on my rental property, which I then used to replace the roof on my primary residence, and only patched the rental's roof. The insurance company is now accusing me of fraud, and has referred the case to the Texas Dept of Insurance Fraud Division. What should be my next step? Should I put a roof on the rental property out of my own pocket now? Do I need an attorney at this point?
