Legal Question in Landlord & Tenant Law in Texas

Broken A/C

I live in an apt. and my A/C has been broken since 7/10/03 and will not be fixed until 7/15/03. Am I entitled to compensation or deduction of my rent since myself & my son have been unable to live in the apt for 6 days?

Re: Broken A/C

You would be entitled to reimbursement only if you have made a written request for the repair, seven days has passed and the repair has not been made. Go ahead and do that but also immediately call Code Enforcement. I don't know what city you are in. I am in Dallas and Dallas Code Enforcement will go to your apartment and issue a citation to the owner to have the A/C fixed ASAP or the owner will be subject to payment of a fine. There is a specific city ordinance which governs how cool and in winter how hot the temperature must be maintained in apartments. I would imagine there are similar ordinances in other cities and all cities have Code Enforcement. Their failure to maintain the A/C is a health violation. City Code Enforcement should do something about it pretty quick.
