Legal Question in Landlord & Tenant Law in Texas

illegal eviction

written contract with apt. indicates a security deposit of $50. However to ensure my fulfillment of my tenant contract I paid in advance (2) months rent which was paid out over three months and was not noted on contract only posted to the apt's payment rent ledger. Office personal erroneously recorded the additional rent as a security deposit instead of rent in advance and now the leasing office is refusing to apply my advance rent payment for my last 2 months of my contract. The leasing office has filed to evict me since I refused to pay any more rent.

Re: illegal eviction

Obviously, you should have had this properly reduced to writing. Now, you will need to either pay the rent, or hope you can convince the JP at the eviction hearing that you are correct, and they are wrong.
