Legal Question in Landlord & Tenant Law in Texas

I went to rent some apartments the other day. They asked me to give them a 350 dollar deposit that would be refunded back if I did not qualify and 29 dollar aplicatio fee. When they ran my aplication they found out that my husband owed some money to the old apartments that we lived at which I did not know about, they said they could not rent me the apartment I said fine can I have my deposit back they said no because on the aplication they ask if I have any broken leases and I said no, so my deposit cannot be returned anymore. Is that legal? Can they do that?

Sue them in small claims court for the $350. They're dirty, and they're crooks.
