Legal Question in Personal Injury in Texas

24 y/o dtr involved in car accident 9/09 in Texas. Making left turn through a traffic light that she said was green, but 1 eyewitness disputed. 1 oncoming car stopped, 2nd oncoming car hit dtr's car in back passenger door. Insurance co. assigned 80% fault to dtr. Lady in other car claimed injuries and incurred $187,000 of treatment. Insurance companies still dealing with claims. Lady threatened to sue dtr for money. As the parents of dtr we recently gave her $25,000 for her wedding in 10/2011; should dtr return the $25,000 in case dtr is sued so it is not considered as part of her estate.

Tell your or daughter's insurance company to pay the policy limits in condition for claimant signing a release that releases claims against your daughter and the ins. co.

Talk to estate planning attorney and $25K gift you gave to daughter to see if it could be seized in a lawsuit.
