Legal Question in Personal Injury in Texas

Accident in restaurant

My family went out to dinner last night and was sat in a booth living a my 8 month old to sit in a high chair in a narrow aisle making it inpossible for people to get by. Within a minutes of sitting down a waiter came around the corner with a try of food over his head. His foot ran into the very High chair my daughter was in, causing the waiter to loose his balance dropping the tray of food. The food was very hot and a whole plate of hot shrimp wasted onto her head. My mother reach out to remove the food as soon as it was wasted and the paramedics were called and my daughter was checked out. She seemed ok after the check her for over thirty mintues. I wondering if I should seek restitution from the restaurant for the trauma caused to my daughter and our family. Are thier violations of unsafe procdures or negliagance on the restaurant? I beleive if it were not for my mothers swift response and action taken protect my daughter she would be severlly burned from the accident.
