Legal Question in Personal Injury in Texas

Auto Accident and possible whiplash

I was backed into by a truck while sitting at a gas station the other day. It was not my fault. I was about to turn left onto a street and this lady in a truck backed into the drivers side of my car while I was waiting to turn. She admitted it was her fault. She said she thought I had already gone.

She did put a dent in my car which I got an estimate on. Well the officer asked us if we needed an ambulance and we both said no, I didn't feel bad at the time. Well yesterday I had a headache all day. THis morning I woke up and my neck was hurting and I had a headache. IT felt stiff. I have had a headache most of the day and my neck around my shoulder area has been hurting. I have not gone to the ER because they will just tell me to go to my doc Monday. What should I do now? The police did not issue any tickets or anything, just a Motor Vehicle Accident Courtesy Report. He did give me a Driver's Accident Report to fill out but I have not done so yet. I haven't felt good all day and I just don't know where to go from here. Please help me.

Re: Auto Accident and possible whiplash

i am unable to determine from the information whether you got the other driver's name, address and the identity of her insurance company. if you did, i would contact asap. then i would certainly be checked out by your family physician. the repairs to your vehicle should be paid by the other driver's insurance company. as to your injury claim you can expect that the insurance company will question the legitimacy of the claim because it sounds like the amount of car damage is not significant and you have waited several days before seeking medical care. so please be forwarned about that. finally, the driver's accident report should be filled out and filed as soon as possible. i hope this helps. bill featherston
