obtaining cell phone records

How do I legally obtain the cell phone records of the person that ran into me. Police report states: unit 1 (other driver) was making a left hand turn. The front right corner of unit 1 (other driver) struck unit 2 (me) near the driver's door. I want to prove he was on his cell phone talking instead of watching the road. Too bad it wasn't in Okla. where it is mandatory for the police to pull cell phone records.

You would have to have a lawsuit to subpoena records. You could file for a deposition prior to lawsuit, but the cost is the same.
