Legal Question in Personal Injury in Texas

I received a refund check from the hospital I was taken to when I had my accident on 6/19/09. It was written for me and the insurance that settled my claim Why does it have both our names on it? Who has claim to the money? The check is for $2464.04. The original $2464.04 was paid out of my settlement offer. All it says on the bottom is PIP Overpayment and HMC Refund.

It has both your name and the name of your insurance company on the check in case the insuance company has any claim to any of those funds. I cannot tell from your question what they check was for. If you had a lawyer in the case, ask that lawyer. If you did not, I cannot advise you because I do not know what happened with the first 42,464.04. You wrote that it was "paid out of my settlement offer," but you don't say who it was paid to or why or what it was for. You can also call the hospital and ask them what the check is for.
