settlement out of court

if a negligence lawsuit against a major corporation is filed by a mother for her disabled child, and the corporation wants to settle out of court, can the settlement payment be paid directly to the mother so she may take care of the child, without the money going into a trust fund, or, since it's settled out of court, is the payment to be however the mother and the corporation agree to, without restrictions ?

Ordinarily, the corporation will insist on making the payments to a trust fund or into the registry of the court for the availability of the minor. I would be surprised if the corp. would allow you easy access to the funds because the settlement is for the child.
