You can make it a claim against the driver 's insurance. Get medical treatment ASAP.

DO NOT DO THIS WITHOUT A LAWYER

You should not give a statement, give access to your medical information or sign any insurance company forms without speaking to a lawyer.

The insurance company is not your friend and is not concerned with your injuries and pain.

Their goal is to make $ by paying as little as possible on the claim. They will frustrate you by delaying payment, giving you a low offer, or denying the claim hoping you will get mad and go away.

Notice D and his Ins carrier (noted on the police report) of your claims for Med, wages, impairment, and pain, suffering and mental anguish all past and future and disfigurement.

Check CarMax and AutoNation for value of cars as close to yours as you can find.

Get bills for recent improvements to your car, and make sure they pay you sales tax and limited car rental for your loss of use.

Notify your own carrier of a PIP claim and an UM/UIM claim on your own policy, if you have such coverage.

Hire a lawyer. Ins. companies are not even paying the medical bills.

However if yyou have no injuries, or you were hurt and have not seen a doctor, you are out of luck, as you have no leverage and will have to pay a lawyer out of pocket. since tort claims typically do not allow for recovery of attorney's fees.
