Condo Right of First Refusal TX

Our condo declarations state that we have right of first refusal. However our BOD has never passed the units up for sale on to the owners. Instead they pass on the right of first refusal. Can they do that? Seems to me it was to benefit the owners, not just the BOD.

I would have to read the declarations to be sure. Usually the right runs to the Association, not the individual owners. What a mess THAT would be if it did!
