Legal Question in Real Estate Law in Texas

Eviction after major back surgery

My husband had 2 major back surgeries in July. We are not behind on rent, never paid rent late in 18 months. We are told we are being evicted because my husband cursed a neighbor. What rights do we have, we are leasing a home.

Re: Eviction after major back surgery

Hello there -

The short answer to your question is: it depends. Mostly the issue would hinge on provisions in your lease contract / rental agreement. I would be willing to bet that there is no provision within that document which would allow "eviction" on that ground. If there is no contract, then the term can be ended with proper notice on any ground. The key, though, is "proper notice". If you have a lease contract,I would be happy to review it for you. If not, I would be willing to consult with you regarding Texas property laws which apply in the absence of lease agreements.
