Legal Question in Real Estate Law in Texas

forgery of change in lease

I recently received a copy of my rental lease and there is a change in the amount of rent to be paid. My rent has been $706.00 for the term of my lease which will be up in October. The typed $706.00 is marked through with a line and above it was written $760.00 and two sets of initials are next to the change. One set of initials are ineligible and the other set is SS which are my initials however, I NEVER initialled this change and have NEVER paid $760.00 a month for rent. Someone forged my initials and want to make sure I will not be held accountable for this extra ''unauthorized'' change in rent. I do not understand why someone would forge such a change in my lease.

Re: forgery of change in lease

The landlord is entitled to increase your rent at the expiration of a lease, unless you have an option in the lease that says otherwise. If you object to the increase you become a month to month or holdover tenant, depending on what the lease says. the landlord through proper procedures can then evict you and obtain possession of the premises. As to the forgery, if you did not agree to a lease extension you have no obligation to be bound by the lease terms. Larry Maun 713-266-2560
