Legal Question in Real Estate Law in Texas

my brother n law passed away a few months ago. my wife and kids and myself have been living in his house for a few years now, and we want to know what we need to do to change the title over to our name so we can remodel the house. He left no will or anything and all the brothers and sisters agree to let us continue with the house. I think i need some form that everyone needs to sign explaining that everyone agrees to let us take over the house. the house is paid in full and worth less than 50,000. Am i gonna need an attorney to do this or is this something i can do my self by going to the county for the form and following the directions??????

You will likely need an attorney to get this done properly.

First you will need a document showing how title passed upon your brother in law's death, presumably to his brothers and sisters. Hopefully an affidavit of heirship will be sufficient.

Then you will need a gift deed from his heirs (probably the brothers and sisters) to you and your wife.

An attorney can evaluate the situation in more detail to make sure what documents are needed, then the attorney can draft the documents for you. If you can arrange to get them signed, without the attorney having to deal with those logistics, that might save you some money.
