Can I bring a lawsuit against an attorney that gave me incorrect information in

In 1988, my father died and had no will. When his estate was probated the attorney handling the case told me, his only son, that he had no checking account. I recently found thru unclaimed property that he did have a checking account. I would like to know if I can now bring a lawsuit against the attorney for malpractice, I thought at the time he must have a checking account but was distrought by the death and assumed the attorney was being honest. I now feel that the attorney and my step mother had some kind of arrangement and I should have some legal recourse.

If the checking account was unclaimed, it would appear that the attorney didn't know it existed either, and so he told you what he knew. That's not malpractice.

Who was the executor of the estate? It's the executor's responsibility to locate estate assets as best they can. If the executor hid that asset, you may have a cause of action.
