Legal Question in Wills and Trusts in Texas

my husband dies with a will, we had no debt except for our mortgage. The home was in both our names. He left everything to me. Do I need to have the will probated? I would like to sell my home.

Although there may be alternatives to probating his will, it's probably not that expensive to do it the correct way. Texas probate is not necessarily an expensive affair. Did you husband have debts (aside from the real estate)? If not, then there's a summary probate procedure you can do (muniment of title) which will clear title, allowing you to sell the home.
