Legal Question in Wills and Trusts in Texas

Life estate

Our mother died in 1975 without a will. Community property was 200 acres, house, vehicles, farm equipment, barns, tools, etc. Our father remarried in 1978. He died in 1997. His will left his last wife a life estate in the house, vehicles, and farm equipment. We had inherited half interest from our mother's part of the community property. We are being denied our rights to our part because of the life estate granted by my father. He did not own the whole interest so how can he give our half away in a life estate?

Re: Life estate

Your dad didn't give away your estate, nor did he give it in the life estate. You really need an attorney to look at all the circumstances and advise you. Your problem is greater than the question you asked.
