Legal Question in Wills and Trusts in Texas

misspelled beneficiary name

My sister and I are beneficiaries for our aunt's Will, who passed earlier this year. My sister's last name is misspelled by just 1 letter. I am the executor, and am planning to probate the will. Will I run into problems? How can I fix this?

Re: misspelled beneficiary name

This should not be a big deal; it happens all the time. So long as there is no question as to identity, then you simply distribute to her. If you have to deed any property to her, then you may want to make sure your attorney adds extra language to the deed clarifying the wrong and right spellings of her name. You might also want to get an affidavit of identity from her, saying that she is really the same person as the misspelled name.
