Legal Question in Wills and Trusts in Texas

My sister is waiting for statue of limitations so she can inherit dad's money.

My dad passed away and left a will leaving everything to my mother. He was the locomotive yard master in Dallas and had money CD's and a life insurance policy. These were never cashed in. My sister lived in my mother's house at the time of my mother's death and was left executor of the will. She is claiming that the CD's were cashed in by my brother illegally and nothing can be done. She is now saying that there was no life insurance policy. It has been almost 2 years since my mothers death. I just now was able to get my dad's social security number, but I do not know where I can get the information I need to prove her wrong. He worked at this railroad all his life and retired from there. Originally, everything was to be divided equally among to the children upon both of their deaths. I have a copy of this will from my mother. Then my sister comes up with a different will, which I also have a copy, but the signatures do not match. My sister has always pushed me and my brothers out of everything, but this time I want to stop her and see that she does us right. I would appreciate any advice. She needs to remember that this family consists of 4 boys and 1 girl, NOT just 1 girl ! Thanks.

You and your siblings are going to have to hire a lawyer to help you on that. It is far too complicated to try and handle by yourself.

I agree with Mr. Bradie. You can file an Application to Probate the Will and ask for an accounting of the probate assets from your sister. If all the money is gone, she is responsible, but recouping anything is going to be difficult it appears to me.
