Legal Question in Wills and Trusts in Texas

transfering trust from Tennessee to Texas

My wife and I created a revocable living trust several years ago in Tennessee. We have now moved to (reside) in Texas. What if anything to we need to change and how does the change get recorded in Texas? With this trust we also created joint power of attorney, medical power of attorney, Pour over wills and living wills.

Re: transfering trust from Tennessee to Texas

Contact a lawyer that handles probate and estate work. Without knowing what the trust says, it would be impossible for me to say what has to change.

Texas as its own durable powers of attorney, powers of attorney for health care, living wills (physicians directives) and probate requirements. While your pourover will would be valid in Texas, if valid when made in Tennessee, there are some Texas provisions you may want to take advantage of with a Texas will; such as independent executors serving without bond.
