Legal Question in Workers Comp in Texas

lump sum benefits

I had knee surgery 5 months ago, and have been thru much physical therapy, but still not able to put any pressure on it. I have just been denied any more therapy. My question is where to go from here? I understand from other questions on this board, that an MMI is to be done, and impairment rating is given. What happens from that impairment rating? Am I given a choice of a lump sum, or so many weeks equal to the lump sum? Will I need a lawyer?

Re: lump sum benefits

From the information given, you may not be ready to return to work. If your doctor has not released you to return to work, you may not be ready for an impairment rating. Your doctor will need to appeal the denial of therapy. I recommend that you speak with an attorney since the insurance company is beginning to deny benefits. Please feel free to call us.
