Legal Question in Immigration Law in Turkey

v visa

my brother who lives in iran and is 18 years old has received a letter to apply for v visa based on his father's petition. he cant live iran since he is 18 and has to go for national service. he is in his mom's passport and cant have his own passport until he finishes the service. If he somehow enters turkey and joins his mom, will he have any problem with v visa because he is in his mom's passport. can he leave turkey and travel to u.s with his mom's passport.

2.My second brother who is 21 1/2, and was petitioned for by my dad 3 years ago has not recieved any v visa papers. is he eligible for v visa since he has turned 21?

Your youngest brother might get away with immigrating on your mother's passport but he will not be issued his own once he is in the US. I do not think the Iranian consulate will issue one to him if he evades his military service. The American consulate may require that he get his won passport, as well. I would call the consulate in Turkey and find out the requirements.

Your second brother is clearly inelgible. 21 years old is the cut-off.

If your 18 year old brother gets the V visa then he can come to the U.S. So long as there is a valid passport it's okay.

Unfortunately, your older brother is not eligible for the V visa b/c he is over 21.
