Indian Arbitration Act,1996

Where the preconditions for invoking the arbitration proceedings have been frustrated by inaction on the part of a government party,can the preconditions be waived and also can the other non government party affected by such inaction proceed by invoking the procedure to initiate arbitration proceedings?

Under the terms of the Arbitration act,if the contract contains an arbitration clause,either of the parties can file an arbitration petition before the court to get an arbitrator appointed.
