Legal Question in Family Law in United Kingdom

cross representation of solicitors

i recently sued my husband for divorce - the solicitor acting for him as the respondent represented me and my family 2 years previous against his parents who were then my parents neighbours (for assult). Is this correct that the same solicitor can act for him against me for ancillary relife?

Re: cross representation of solicitors

Firstly, you do not state what jurisdictiion you are in, and the answer to your question could vary from one jurisdiction to another. If the solicitor acting for your husband obtained any information when he represented you two years earlier that could be of use in the divorce proceeding in which he is now acting against you, then yes. There is definitely a conflict of interest. If there was no such information, then the issue is less clear. If you are in the UK, then you should ask someone at the Law Society who will presumably refer you to their Ethics Committee.
