Legal Question in Family Law in United Kingdom

Emigrate with child from previous marriage

I am already an australian citizen currently living in the UK with my second husband. We have 2 children one from my previous marriage. We are looking to emigrate back to australia to join my family out there and need to know if my first husband can object, if so what would be the best way for me to deal with this. My daughter from my previous marriage was born in Australia.

Re: Emigrate with child from previous marriage

It may well be that you will have to seek leave of the UK court before removing your daughter from the jurisdiction. This need not be particularly difficult or expensive and if necessary I will be pleased to advise you further on this.

However before advising finally I would need to know more of your matrimonial history and the current arrangements for your daughter.

Please feel free to contact us if you need this further advice.
