marital breakdown

I have been separated from my husband for 18 months. If either of us want a divorce do we count two years from the date he left me or do we have to have something on paper called a legal separation and if so will the date have to go from there. Also I have been told that you cannot get into another relationship without this legal separation paperwork. Is this correct.

The period of separation to entitle you to a divorce on the grounds of two years separation and consent will commence on the date of your actual separation. There is no need for any documentation to establish the date of the separation as you will swear to the truth of this when applying for pronouncement of your divorce.

A relationship during the period of marriage can constitute unreasonable behaviour or adultery thereby establishing grounds for divorce. If you are intending to enter into a relationship before you are able to divorce it can be sensible to agree a separation agreement which can cover the situation.
