Does the eggshell case apply to my own situation?

Hello,

I was employed in an office capacity 3 years ago and suffered a disc prolapse as a direct result of work conditions/poor workstation, posture etc. This was agreed and proven by Health and Safety but every consultant says that there must have been a pre-exiting condition waiting to happen. My lawyer says there is no chance of proving causation. Is there any course of action you can suggest for me as the only back problem I had was 12 years earlier for muscle strain which was not disc related. I am still suffering today. A couple of initial points. Firstly I am concerned in that this injury apparently occurred three years ago. The limitation period had for personal injury claims is three years and if you do not issue proceedings within three years of becoming aware of the injury you will be unable to do so.

My other point is that even if the medical evidence does show a pre-existing condition, this does not necessarily mean that you do not have a claim.
