Legal Question in Family Law in Utah

child visitation

My 9 year old step daughter at times does not want to go to her biological dads house. My wife has joint custody and she currently goes to his house 13-15 days a month. Do we have to refile custody papers to get the days reduced? We have a stong feeling the biologicaldad will not reduce the days even at his daughter wishes. Thanks for your time.

A nine year old is barely old enough to make such a decision. It would be wise for her - and perhaps both families - to go through some counseling to ascertain all of the problems and factors involved. Often a child of her age is under some unspoken or perceived pressure to please one parent more than the other. Or there may be some problems which need to be addressed.

In order to change a current court ordered visitation schedule a new court order is required.
