Legal Question in Family Law in Utah

I need to clarify a previous question. I have been married for 7 years and do not have children in this marriage. My children's father (first marriage) has not paid child or medical support during much of my current marriage, but the children have lived with us. My current spouse believes what my ex owes during this time is part of our current assets. We are divorcing, and I don't know if he can include this as an asset? Chances are I will never see the money.

The medical expenses owed by your first husband and unpaid child support are NOT part of your marital estate. Your current husband has no right to that money - if ever paid.

Your current spouse is incorrect. Your child support and unreimbursed medical expenses are not a martial asset. I'm assuming once your husband tries to bring this up with his attorney, he will be set straight. Should you need legal counsel, you're welcome to contact me. I offer a free initial consultation.
