Legal Question in Family Law in Utah

She dropped 3 yrs. worth of medical bills on my lap...

My question is, can my ex-wife legally drop 2-3 yrs. worth of medical bills for my son from that marriage, on my lap and give me just six months to pay up. My divorce decree states the following, "Defendant shall be required to maintain all military benefits available to him for the use and benefit of the minor child, including but not limited to health, accident and dental insurance, as long as available to him. That in the event defendant is no longer enlisted in the military services, he shall be required to maintain health, accident and dental insurance for the benefit of the minor child, as long as available to him through his place (s) of employment. Further, the parties shall equally share all expenses that are not covered by insurance." We were divorced in Utah in 1985, I am in the military and this is the first time she has done this. I have had insurance on him from birth and she said it doesn't state in the decree that she has to use my insurance, but if I need to maintain insurance for him, I think she needs to use it. Also, is there a time limit that she has to submit claims/bills to me for reimburement. I thank you, I hope you can help or point me in the right direction.

You will probably need to get to Court to settle this. I agree with your position, but I cannot say that the laws of your state will agree with us. I am not licensed in your state, I am licensed only in Montana. You must consult with an experienced family law attorney in your state. In some cases, attorney fees can be awarded to the prevailing party, but that may or may not be possible in your case. Good Luck.
