house equity and split

My ex-spouse and I were ordered to sell our home and split the equity. I have been in the home for two years and solely making payments. My ex-spouse pays alimony. Our home is in terrible condition. My spouse will not accept anything except top dollar, so I am going to be in this for a long time. I want to petition the court to be reimbursed my mortgage payments at closing. Does this seem equitable? The Judge must have had a reason he did not order this in the first place. But then again my attorney never asked during trial.

You can always ask the court to amend the order or issue a new order. You could be charged a reasonable rate for the rental value of the house if that is less than the mortgage payment. You can also take an offer to court to get an order from the court to sell the house.
