Legal Question in Civil Litigation in Utah

I live in Utah, went back to MS back in sept. A guy rear-ended me and my son, we was not hurt but a little shaken. The cops came and arrested him for dui, drugs in rhe car and had a warrant for his arrest. weeks went by, I am now told by the insurance from the company that hit me that they are not going pay for the damages of the rental car that I was driving, because the boss of the company did not give the driver(employee) permission to drive the company van only to jobs. this happen on a sunday afternoon. I get a bill from the rental company for about 4500 for repairs. my insurance said they would have to pay it, which I will have to pay the deductable of 500. I need to knoww what and if there is anything I can do....
