Legal Question in Appeals and Writs in Virginia

Child Survivor Benefits

We have had permanent guardianship of our granddaughter since an infant (she 12yrs now). Parents right terminated, no contact since infant. My husband passed and when I applied for benefits, she was denied. I have been appealing but they say we didn't adopt her prior to his death. I have been told by several people she is and I am caught in a loop hole that requires legal help. Can you advise/help?

Re: Child Survivor Benefits

You should arrange for a consultation

with an attorney familiar with guardianship and adoption matters in the Commonwealth and allow this person to review all of the documents and papers associated with your granddaughter's case(s)so that you can be advised as to what your legal status may actually be with respect to your granddaughter and whether or not the child may be eligible for SS survivorship benefits as a dependent of your deceased husband.
