Legal Question in Business Law in Virginia

What is Required in VA?

I own a small construction sole proprietorship company. I am starting to employ individuals and want to know what type of benefits are mandatory to be offered in VA. I am not going to offer any medical, and leave benefits, but wanted to know what i NEED to offer by law. In particular, Unemployment compensation, FMLA, and others. I do not need Worker's comp at the current time since i don't have more than 3 employees. Thanks.

Re: What is Required in VA?

Rules regarding Virginia Unemployment Compensation which would be applicable to your situation:

(A) If you had at least one employee to whom you paid wages of $1500 or more in the current or preceding calendar year, or

(B) If you paid for one or more persons for their services/labor for any portion of a day in separate weekly periods(don't have to be consecutive) totaling 20 or more during the current or preceding calendar year,

you're considered an employing unit and are under the Virginia Unemployment Compensation Program.

(See Va. Code Sec. 60.2-210.)

FMLA would not be applicable to you since as a private employer you do not have 50 or more employees.
