Legal Question in Business Law in Virginia

Towing Company

I had my car towed about a month ago. It got towed teice in same week. I paid for the towing fee but as soon as I picked up the car, I knew that the suspension was having a problem. I took the car right away to a dealership and found out that the sway link was broken in 2 pieces and the tire rods needed to be replaced (while towing all the weight was set on the front tires and it was very loose). I have the picture of the broken sway link and have witnessess that saw my car (underneath) before it got towed and after. The total for the parts and the labor came up to 400. I showed the owner the picture of the damage and the receipt of the parts. He agreed to come take a look at the car so he could check out the new parts I put in. We made an appointment but he never showed up. He's been avoiding me for a month and now only option I have got is to file up for the civil court. I seem to have a good case because of the pictures, witness and receipt. I wanted just the $400 for the damage without going to court but the owner has been ignoring my call. Now I want to sue them for the time they wasted and for the time I'll be wasting with the court. What is your input on this? Do I have a good chance?

Thanks for your help.

Re: Towing Company

Well, what are you waiting for to get justice for your claim(s) by filing your case in your small claims district court?

File your case without further dithering nor awaiting the approval of others (who may be no more

than smirking observers on the sidelines---and secretly gleeful in your hoped for failure).

The Gemmans call it SCHADENFREUDE(I believe).
