Legal Question in Consumer Law in Virginia

Hello,

I live in the western part of Virginia, and my wife and I went on vacation to VA Beach early this summer. We stayed at a hotel there as reserved for one night, but after having such a good time, we decided to stay an extra day. We talked to the hotel, and they said that was fine. The next day when we were exiting, and preparing to pay the extra day (we paid 2 days prior for the upcoming day), instead of paying for one night, the employee overcharged us. We have a receipt from the hotel for the return of our money, and yet after repeated calls, the manager refused to even speak with us once about putting the charge back on our card.

My next step will be a certified letter and time frame for response.

My question is this.......if I have to go to small claims, does the law provide for sueing above actual cost to help pay for my time, travel expenses, and aggravation?

Hi there--yes! just be sure the amount falls under the small claims court's jurisdictional maximum of $5,000. A lawyer letter threatening suit might do the trick.
